Overview

Stibbe has closely followed the recent liberalization of the energy sector and acts as counsel for energy matters to i.a. production and distribution companies, large industrial energy users and federal, regional and local authorities.

Stibbe’s services in this respect include, i.a.:

drafting of all types of contracts related to gas and electricity supply and distribution
advising on various aspects of power plant or pipeline constructions
advising on corporate transactions in the energy sector
advising on the moving of cables, pipelines and auxiliary infrastructure
advising on real estate aspects of grid infrastructure
litigating, both in the administrative court and the civil courts, disputes concerning regulatory matters or energy related agreements or rights (including tariff disputes)

Stibbe is prominently involved in the sector of CO₂ emission rights, and advised i.a.:

on the first federal tender procedure for Joint Implementation (JI) and Clean Development (CDM) Projects
on standard Emission Reduction Purchase Agreements
on the Royal Decree on the Belgian emissions trading Registry
on the establishment of a Flemish ESR 95 neutral Kyoto fund

Stibbe’s energy task force consists of dedicated members from various specialised departments covering administrative and regulatory law, European, corporate, real estate, construction and engineering, tax, environmental and liability law.
