Cross-border litigation
Litigation has no borders. Companies involved in international business transactions may find themselves drawn into litigation before a foreign court or before an arbitral tribunal sitting outside their jurisdiction. They may seek to enforce in country X a judgment obtained in country Y where the debtor’s assets are located. They may need to coordinate multi-jurisdictional litigation involving the same or similar disputes, such as a dispute involving patent rights.
Stibbe offers a wide range of services in the field of cross border litigation, based on a broad practical experience combined with a thorough understanding of Belgian, European and international law. Our services cover all questions involved in cross-border litigation, including how to:
- challenge the jurisdiction of Belgian courts;
- enforce foreign judgments in Belgium;
- obtain provisional and protective measures such as attachment of assets;
- serve process on a Belgian or foreign defendant and how to resist service of process;
- obtain evidence in Belgium to use in foreign proceedings;
- challenge anti-suit injunctions.
Our team can also call on the assistance of lawyers in all our offices and our alliance partners Herbert Smith and Gleiss Lutz.
